1.Agreement to these terms
These Terms of Service (the “Terms”) form a binding agreement between you and GetBook (“GetBook”, “we”, “us” or “our”) governing your access to and use of the GetBook website, booking platform, dashboards, and related services (together, the “Service”).
By creating an account, clicking “I agree”, or using the Service, you accept these Terms. If you are using the Service on behalf of a business or other organisation, you represent that you have authority to bind that organisation, and “you” refers to that organisation. If you do not agree, do not use the Service.
2.What the Service is
GetBook is an online booking and business-management platform. It lets service businesses — including salons, clinics, studios, rentals, classes, tours and similar — publish a booking page and website, manage services, staff, schedules, customers, bookings, payments and reporting.
GetBook provides the software. It is not a party to the bookings, appointments, sales or other transactions that take place between a business using the Service (a “Business”) and that Business’s own clients (“End Clients”). Each Business is solely responsible for the services it offers, the prices it sets, and its dealings with its End Clients.
3.Accounts and eligibility
You must be at least 18 years old, or the age of majority in your jurisdiction, to create an account. You are responsible for the accuracy of the information you provide and for keeping your login credentials confidential.
- You are responsible for all activity that happens under your account, including the acts of team members you invite.
- Notify us promptly at hello@getbook.cloud if you suspect any unauthorised use of your account.
- Roles and permissions (owner, admin, manager, and other member roles) are yours to assign and manage within your workspace.
4.Plans, trials, billing and refunds
Free plan and trials
We may offer a free plan and time-limited trials of paid plans. Trial features, limits and duration are described at sign-up and may change. At the end of a trial you may be asked to choose a paid plan to keep using premium features.
Subscriptions and renewal
Paid plans are billed in advance on a recurring basis (for example monthly or annually) at the price shown when you subscribe. Unless you cancel before the end of the current billing period, your subscription renews automatically for another period and we charge your payment method on file.
Cancellation
You may cancel at any time from your subscription settings. Cancellation takes effect at the end of the current billing period; you keep access to paid features until then.
Taxes and refunds
Fees are exclusive of taxes unless stated otherwise; you are responsible for any applicable taxes. Except where required by law, fees are non-refundable and we do not provide refunds or credits for partial periods, unused features, or downgrades.
5.Acceptable use
You agree not to use the Service to:
- break any law, regulation, or third-party right, or offer illegal goods or services;
- upload malware, attempt to gain unauthorised access, probe or disrupt the Service, or circumvent its security or usage limits;
- send spam, deceptive, or unsolicited communications, or harvest data about other users;
- post content that is unlawful, infringing, hateful, harassing, or that you do not have the right to share;
- resell, sublicense, or provide the Service to third parties except as expressly permitted; or
- copy, modify, reverse-engineer, or create derivative works of the Service, except to the extent that restriction is prohibited by law.
6.Your content and data
You and your Business retain all rights to the content and data you submit to the Service — your logo, images, service catalogue, customer records, bookings and similar (“Your Content”). You grant GetBook a worldwide, non-exclusive licence to host, process, transmit and display Your Content solely to operate and provide the Service to you.
You are responsible for Your Content and for having the necessary rights and consents to use it — including any consent required from your End Clients to store and process their personal information through the Service. How we handle personal data is described in our Privacy Policy and Data Storage pages.
7.Our intellectual property
The Service, including its software, design, branding, and content we create, is owned by GetBook or its licensors and is protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable, revocable licence to use the Service in accordance with these Terms. All rights not expressly granted are reserved. “GetBook” and our logo are our marks and may not be used without permission.
8.Third-party services
The Service may integrate with or link to third-party products (for example payment, messaging, mapping or analytics providers). Those services are governed by their own terms and privacy policies, and we are not responsible for them. Your use of a third-party integration is at your own risk.
9.Availability, changes and support
We work to keep the Service available and reliable, but it is provided on an “as available” basis and may occasionally be unavailable for maintenance, updates, or reasons outside our control. We may add, change, or remove features over time. We provide support primarily by email at hello@getbook.cloud.
10.Suspension and termination
You may stop using the Service and close your account at any time. We may suspend or terminate your access if you breach these Terms, if required by law, or to protect the Service or other users. Where practical, we will give notice.
On termination, your right to use the Service ends. We will make Your Content available for export for a limited period, after which it may be deleted in line with our data-retention practices.
11.Disclaimers
To the maximum extent permitted by law, the Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure, or that it will meet your requirements.
12.Limitation of liability
To the maximum extent permitted by law, GetBook will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill. Our total liability arising out of or relating to the Service will not exceed the greater of the amounts you paid us for the Service in the twelve (12) months before the event giving rise to the claim, or PHP 5,000. Some jurisdictions do not allow certain limitations, so some of these may not apply to you.
13.Indemnification
You agree to indemnify and hold GetBook harmless from claims, damages, and expenses (including reasonable legal fees) arising from Your Content, your use of the Service, your dealings with End Clients, or your breach of these Terms or of any law.
14.Governing law and disputes
These Terms are governed by the laws of the Republic of the Philippines, without regard to its conflict-of-laws rules. You agree that the courts located in the Philippines will have exclusive jurisdiction over any dispute arising from these Terms or the Service, except that either party may seek injunctive relief where appropriate.
15.Changes to these terms
We may update these Terms from time to time. If we make material changes, we will notify you (for example by email or an in-app notice) before they take effect. Your continued use of the Service after changes become effective means you accept the updated Terms.
